INFORMATION CONCERNING ARTICLES 13 AND 14 OF GDPR EUROPEAN REGULATION NUMBER 679/2019

Srl hereby informs “you” — our suppliers, clients, partners, and others involved in contractual and/or pre-contractual activities with us, A.T.B. Srl (also referred to below as “us,” “our,” and “we”) — the following about our compliance with articles 13 and 14 of European Regulation number 679/2019, the “European Regulation for the Protection of Personal Data,” commonly referred to as “GDPR.”

DATA SUBJECT TO GDPR REGULATIONS

The following activities between you and us are subject to GDPR privacy regulations.

  • In-person visits, phone calls, and emails.
  • Requests for information at trade shows and other similar marketing events.
  • Direct contact with us using email, or by completing any forms posted on the internet.
  • Requests for commercial information, quotes, and so forth from us.
  • Requests for information from us using our website, a supplier’s website, a client’s website, a partner’s website, or any other website.
  • Any transmission and/or transaction between you and us that is needed to complete a supplier’s order for any services/goods that we provide to you or you purchase from us.
  • Any contact we make with you as a result of your participation in trade fairs, sales events, and other commercial initiatives.

PURPOSE OF THE GDPR REGULATIONS

The purpose of the GDPR regulations is to protect the personal data of people working on behalf of our suppliers, partners, and others. The GDPR regulations cover the following activities:

  • Forwarding communications of any kind to you, using a different mode of communication than the one you used in your original contact.
  • Asking for additional information about any requests you send to us.
  • Any exchange of information between you and us that aims to build a business relationship, including pre-contractual and post-contractual contact — including our customer-assistance activities.
  • Our executing any obligation described in the applicable laws, regulations, and rules of the European Union, as well as our complying with any measures issued by a public authority having the right to regulate us.
  • You receiving collateral sales-information from us — such as newsletters — by email, or by text messages sent to your cell phone.

REFUSING TO ASSIGN YOUR PERSONAL INFORMATION

You may refuse to assign your personal information to us, but doing so will compromise — in whole or in part — our ability to establish a proper, efficient, and workable business relationship with you at the pre-contractual, contractual, and/or post-contractual phases of our business relationship.

LEGAL BASIS

Processing is necessary for the performance of a contract to which each party is subject, or in order to take pre-contractual or post-contractual measures following the requests of suppliers, clients, partners, or other parties, or A.T.B. Srl, in accordance of article 6.1, letter b of GDPR — that is, for the performance of a legal obligation according to article 6.1, letter c of GDPR.

HOW WE PROTECT YOUR PERSONAL DATA

We affirm that all personal data handled by us will be managed honestly and transparently, using manual or automated tools — including inserting your data into a database, creating a list suitable for storage, and managing and transferring data, and as needed to achieve the above-mentioned aims.

We affirm that A.T.B. Srl have implemented appropriate security measures to protect your personal data and are working with our suppliers, clients, partners, and other parties using measures such as firewalls, anti-virus software, anti-ransomware software, and back-up utilities. In addition, we affirm that we are using appropriate hardware —  such as secure virtual machines and so forth — to keep your personal data secure.

Your data will be processed exclusively by authorized personnel at A.T.B. Srl, who will use it only for specific, agreed, purposes.

RECIPIENTS OF DATA

We affirm that any personal data entrusted to us will not be disclosed to third parties, except on a “need-to-know” basis, or because we have been ordered to do so by a court of law. We do share some limited personal data on a strictly “need-to-know” basis with carefully screened and secure subcontractors, who help us manage, handle, control, and transmit your data.

In particular, they are employees/collaborators who, on the basis of roles and tasks normally carried out by employees, have been legitimated to process personal data, trained to do so within the limits of their skills, and in accordance with the instructions given to them by the data holder. Your personal data will be communicated only when strictly necessary, but are subject to any order or request for information or offers (including the agents of A.T.B. Srl), about their performance, and will be communicated only to provide/deliver goods and/or execute/receive our/your assignment for performance of a contract or service.

For service purposes on software applications, computer networks, and data transfers, data could be accessed by our technical experts or external consultants or people responsible for the company that provides these services. Finally, they can be communicated to the persons authorized to access personal data in accordance with law, regulation, or European community legislation.

An updated list of data controllers, where required, is available at the office of A.T.B. Srl.

DATA TRANSFERS

We will not transfer your personal data to any country that is not a member of the European Union, or to any international organisation. Currently all subcontractors that process personal data for A.T.B. Srl are located within the European Union. Please note that if, at some future time, we need to work with a subcontractor located outside of the European Union, A.T.B. Srl will transfer the data outside the European Union only after adopting precautions established by the Privacy Code and GDPR regulations, and only after obtaining the necessary consent and guarantees from the subcontractors.

DATA RETENTION

The data controller will preserve and treat personal data only for the time needed to carry out the purposes indicated above. Then, personal data will be preserved and not further treated in accordance with the rules expressed in our register of treatment. The retention period, however, can change significantly depending on the following: the purpose, the type of data treatment, and the legal obligations; if the data were treated as part of a financial project, the storage time could be subordinated to the provisions in the notice of the financial institution.

Thereafter, your personal data will deleted, de-indexed, or destroyed.

YOUR RIGHT TO ACCESS YOUR DATA

Outlined below are your rights to access your data, as defined by articles 15 to 22 of the GDPR regulations.

  • You may ask us whether we hold any of your personal data.
  • You may ask us whether your information has been shared with others, and, if so, with whom the data has been shared.
  • You may correct any errors you find in the data.
  • You may ask us to restrict how we share your data.
  • You may ask us to provide your data in a generally recognised file-format for transfer to other data controllers of your choice.
  • You may tell us to stop sending you sales and marketing materials.
  • You may refuse materials we send you as a result of an automated process of personal profiling.
  • You may ask us to limit, correct, or delete any personal data held by us.
  • You may revoke at any time the consent you gave previously about the way your data is handled by us.

Please note, however, that we will need to verify the legitimacy of your request. Please include the following information with any enquiry you make to us, so we can verify your identity and confirm your legal right to access the data in question.

  • Please provide us with a photo-copy of your identity card.
  • Confirm in writing that you have the legal right to access the data in question.
  • Provide specific details to us about the nature and desired result of your data enquiry, so we can take appropriate action.
